El presente artículo aborda la relación ambivalente de Nietzsche con los filósofos helenísticos, para saber por qué, a pesar de la extraordinaria influencia que estas escuelas ejercieron en su pensamiento, Nietzsche se les opone tan violentamente en su obra más tardía. Verificaremos que las principales críticas de Nietzsche a estas escuelas guardan mucha similitud con las que él dirigirá al cristianismo, y a la propia idea de terapia, como una crítica a la tradicional forma de concebirla, que estas escuelas parecen (...) inaugurar y fortalecer. Nietzsche identifica a los filósofos helenísticos como los promotores fundamentales del nihilismo, que él diagnostica como la mayor enfermedad de la cultura occidental, para la que se requiere un médico adecuado y un tratamiento efectivo. La terapia cristiana no fue la única y, principalmente, no fue la primera, pues tiene a los filósofos helenísticos como claros predecesores y precursores. Tampoco estos escaparon al escrutinio crítico de Nietzsche que, en la reconstitución de la historia clínica de la cultura occidental, los identifica como promotores fundamentales de la enfermedad que diagnostica, muy en particular por haber justamente creado las condiciones y el encuadramiento necesarios para la emergencia de la terapia cristiana, preparando el terreno y lanzando las semillas sin las cuales el cristianismo no habría podido surgir y, sobre todo, triunfar. Background: The coronavirus disease 2019 pandemic is impacting the delivery of healthcare worldwide, creating dilemmas related to the duty to care. Although understanding the ethical dilemmas about the duty to care among nurses is necessary to allow effective preparation, few studies have explored these concerns. Aim: This study aimed to identify the ethical dilemmas among clinical nurses in Spain and Chile. It primarily aimed to (1) identify nurses’ agreement with the duty to care despite high risks for themselves and/or their (...) families, (2) describe nurses’ well-being and (3) describe the associations between well-being and the duty to care. Research design: Cross-sectional self-reported anonymous data were collected between May and June 2020 via electronic survey distribution (snowball sampling). Ethical considerations: The Institutional Ethical Review Committees in both countries approved the study (CHUC_2020_33 and 27/2020). Findings: In total, 345 clinical nurses answered the primary question about the duty to care for the sick. Although in the total sample 77.4% agreed they have a duty to care for the sick, significant differences were found between the Spanish and Chilean samples. Overall, 53.6% of the nurses reported low levels of well-being; however, among those reporting low well-being, statistically significant differences were found between Spanish and Chilean nurses as 19.4% and 37.8%, respectively, disagreed with the statement regarding the duty to care. Discussion: Participants in both countries reported several ethical dilemmas, safety fears, consequent stress and low well-being. These results suggest that prompt actions are required to address nurses’ ethical concerns, as they might affect their willingness to work and psychological well-being. Conclusion: Our findings shed light on the ethical dilemmas nurses are facing related to the duty to care. Not only has the coronavirus disease 2019 pandemic given rise to ethical challenges, but it has also affected nurses’ well-being and willingness to work during a pandemic. (shrink)

This Article uses age as an entry point for examining how temporal and methodological issues in egalitarianism make substantive equality an unattractive goal for vulnerability theory. Instead, vulnerability theory should adopt a continuous doctrine of sufficiency, which is a better fit with vulnerability theory’s underlying aims and rhetoric. Instead of evaluating what individuals have in relation to others, sufficiency refocuses the inquiry on whether we have enough throughout the lifecourse. Although US and European research has documented improvement in earnings quality associated with corporate governance characteristics, the situation in Latin America is questionable, given the business environment in which firms operate, which is characterized by controlling family ownership and weak legal protection. The purpose of this study is to examine the relation between the internal mechanisms of Corporate Governance and Earnings Management measured by discretionary accrual. We use a sample of listed Latin American non-financial companies from the period 2006–2009. Our (...) results show how in the Latin American context the role of external directors is limited and that Boards which meet more frequently take a more active position in the monitoring of insiders, so showing a lower use of manipulative practices. In addition, we find a non-linear relation between insider ownership and discretionary accruals, also pointing to the fact that ownership concentration may be a manipulative practices constrictor mechanism only when the ownership of main shareholders is moderate. The findings have important policy implications since this is, to the best of our knowledge, the first study to analyze the relation between the effectiveness of the government and the earnings management behavior. As policy implications, we document how when a country implements controls aimed at reducing corruption, strengthening the rule of law or improving the effectiveness of government, this leads to a reduction in firm earnings management. Natalia Carrillo and Tarja Knuuttila claim that there are two traditions of thinking about idealization offering almost opposite views on their functioning and epistemic status. While one tradition views idealizations as epistemic deficiencies, the other one highlights the epistemic benefits of idealization. Both of them treat idealizations as deliberate misrepresentations, however. They then argue for an artifactual account of idealization, comparing it to the traditional accounts of idealization, and exemplifying it through the Hodgkin and Huxley model of the nerve (...) impulse. From the artifactual perspective, the epistemic benefits and deficiencies introduced by idealization frequently come in a package due to the way idealization draws together different resources in model construction. Accordingly, idealization tends to be holistic in that it is not often easily attributable to some specific parts of the model. They conclude that the artifactual approach offers a unifying view into idealization in that it is able to recover several basic philosophical insights motivating both the deficiency and epistemic benefit accounts, while being simultaneously detached from the idea of distortion by misrepresentation. In the first half of this paper, I argue that there are no sums. The key premise for this conclusion relies on a constraint on what, in certain cases, it takes for something to ground, or metaphysically explain, something else. El autor pretende desentrañar a través de la interpretación jurídica el o los sistemas jurídico penal que los legisladores tomaron en consideración para crear y dar vigencia a los Códigos Penal y de Procedimientos penales vigentes en el Estado Libre y Soberano de México, que fueron tomado como ejemplo, para demostrar que la ley no solo se crea de aspectos abstractos sino también de los criterios que han emitido los juristas en su trabajo.

El presente artículo tiene lugar a partir de un estudio de caso autoetnográfico basado en experiencia de acoso laboral de la autora en una universidad española. El objetivo central del trabajo es examinar, desde un abordaje de ética aplicada, la compleja trama de poder en la que emergen y se desarrollan prácticas de violencia y acoso laboral en instituciones académicas y universitarias. Frente a los dispositivos que facilitan la perpetuación de estas prácticas de violencia y exclusión, así como su naturalización, (...) el artículo propone revisitarlas a la luz de los criterios de las éticas organizacionales y los liderazgos morales, en aras de enriquecer las herramientas ya existentes en distintas universidades para detectar acoso y promover éticas colectivas. El artículo argumenta la necesidad de potenciar las estrategias multimodales contra el acoso laboral en la academia, a fin de que realmente sean efectivas y no parte de protocolos meramente formales. Finalmente, se propone apelar a una profunda crítica desde la ética filosófica en torno a los discursos y prácticas de acoso laboral académico y universitario, para erradicar las violencias no sólo en estas instituciones sino en cualquier ámbito de la vida social. ABSTRACT This article arises from an autoethnographic case study based on the author’s experience of harassment at work in a Spanish university. The main objective is to examine from an approach of applied ethics, the complex web of power in which emerge and develop practices of violence and harassment in academic and university institutions. Against the dispositive that facilitate the perpetuation of these practices of violence and exclusion, as well as their naturalization; the article proposes to revisit them in the light of the criteria of organizational ethics and moral leaderships, to enrich the tools already existing in different universities to detect mobbing and promote collective ethics of others. The article shows and argues the need to strengthen and radicalize the multimodal strategies to eradicate mobbing in the academy and the university so that they are effective and not part of merely formal protocols. Finally, it proposes to appeal to a deep criticism from the philosophy and ethics around the speeches and practices of academic and university mobbing to eradicate violence not only in these institutions but in any area of social life. El Museo Nacional de Ciencia y Tecnología (Madrid), creado en 1980, fue fruto de la ilusión de muchas personalidades de la época especializadas en distintas materias vinculadas con la ciencia y la tecnología, quienes a su vez recogían la de las que habían comprendido desde finales de los años sesenta la enorme ausencia en este campo en nuestro país, siendo muy conscientes del enorme potencial didáctico y cultural, así como científico y tecnológico que ofrecían este tipo de centros. The statue and the lump of clay that constitutes it fail to share all of their kind and modal properties. Therefore, by Leibniz’s Law, the statue is not the lump. Question: What grounds the kind and modal differences between the statue and the lump? In virtue of what is it that the lump of clay, but not the statue, can survive being smashed? This is the grounding problem. Now a number of solutions to the grounding problem require that we substantially (...) revise our view of reality. In this paper, I provide a solution to this problem that does not require such a revision. I then show how my solution to the grounding problem can solve a related problem and answer a related question. The upshot is that the solution I offer is not only non-revisionary, but also fruitful. Through a close examination of philosopher Leopoldo Zea's historicist phenomenology, Mario Saenz offers fresh insights into the role of Mexican intellectuals in the creation of a Latin American "philosophy of liberation". While this philosophy of liberation has been widely recognized as the most intellectual political ideology to emerge from Latin America this century, few scholars have specifically explored the Mexican roots of this intellectual movement. Saenz redresses this imbalance by placing Zea and his contemporary intellectuals firmly within the context of (...) post-revolutionary Mexico, a political and social landscape that fostered criticisms of colonial and neo-colonial structures of dependence. In this paper, I both propose and discuss a novel account of truthmaking. I begin by showing what truthmaking is not: it is not grounding and it is not correspondence. I then show what truthmaking is by offering an account that appeals both to grounding and what I call ‘deep correspondence’. After I present the account and show that it is an account that unifies, I put it to work by showing how it can overcome an objection to truthmaking, how (...) we can get truthmaking from correspondence, what it says about truthmaker necessitation, and how it can explain a connection between truthmaker maximalism and pluralism about truth. Standard approaches to ontological simplicity focus either on the number of things or types a theory posits or on the number of fundamental things or types a theory posits. In this paper, I suggest a ground-theoretic approach that focuses on the number of something else. After getting clear on what this approach amounts to, I motivate it, defend it, and complete it.

The reform of the health care system will include a mandate: Individuals are required to purchase health insurance provided that affordable options are available. But what is affordable health insurance? Three accounts of affordability of health coverage have been advanced. The first two accounts are empirical. The third account is needs-based. All three accounts are inadequate. I propose a fourth, the reasonable tradeoff account, according to which individuals should only be required to make reasonable tradeoffs in order to pay for (...) their health coverage. That is, health insurance is affordable if in order to pay for it one does not to have to sacrifice other benefit(s) that are comparable in importance to the benefits of health coverage. (shrink)

In ‘Parental Virtues: A New Way of Thinking about the Morality of Reproductive Actions’ Rosalind McDougall proposes a virtue-based framework to assess the morality of child selection. Applying the virtue-based account to the selection of children with impairments does not lead, according to McDougall, to an unequivocal answer to the morality of selecting impaired children. In ‘Impairment, Flourishing, and the Moral Nature of Parenthood,’ she also applies the virtue-based account to the discussion of child selection, and claims that couples with (...) an impairment are morally justified in selecting a child with the same impairment. This claim, she maintains, reveals that the flourishing of a child should be understood as requiring environment-specific characteristics. I argue that McDougall's argument begs the question. More importantly, it does not do justice to virtue ethics. I also question to what extent a virtue ethics framework can be successfully applied to discussions about the moral permissibility of reproductive actions. (shrink)

Nancy Jecker’s essay Nothing to be Ashamed of: Sex Robots for Older Adults with Disabilities 1 presents a provocative application of the capabilities approach. Her ethical argument for providing access to sex robots for older adults with disabilities proceeds in five parts: 1. Older adults frequently suffer disabilities that impair sexual functioning. 2. The ability to function sexually is linked to central human capabilities, including: the ability to generate a personally meaningful life narrative; be physically, mentally and emotionally healthy; experience (...) bodily integrity; feel and express a range of human emotions; affiliate deeply with others; and reflect on and choose a plan for their life. 3. Society should take reasonable steps to support these human capabilities at a minimal threshold as part of a broader duty to respect human dignity. 4. Providing access to sex robots comprises part of reasonable efforts to support the six capabilities at a minimal threshold. 5. Therefore, society ought to make reasonable efforts to ensure access to sex robots for older adults with disabilities that impair sexual functioning. I am sympathetic to this line of reasoning, having proposed a series of legal reforms that would facilitate sexual expression among older adults with cognitive impairments as well.2 3 …. (shrink)

From a perspective focused on Law, but open to other fields, an evaluation of the influence of Cicero’s thought the analysis of his main works is attempted. No doubt, Cicero’s ideas have been crucial in the development of Western Culture, and two thousand years later his theories still remain alive.

The descriptive viewpoint in rational choice has generated an important Standard Rational Choice Theory revision. This viewpoint has meant the introduction of relevant psychological considerations that Rational Choice Theory tied to the neoclassical economics is unable to heed In this paper I suggest a way to expand the descriptive viewpoint by theorizing how some factors, coming from the social and cultural environment, operate within rational choice. That troublesome issue concerning the overall validity of economic laws is also a question here; (...) specifically, if these descriptive proposals expand the explanation of the disturbing causes of economic laws, or if they actually call into question their fundamental principles, encouraging consideration of some economic issues in a quite new, different manner. The article explores the moral conflict between individual animal rights and the value of species conservation, using the culling of kangaroos to save earless dragons in Australia as a case study. The author argues that species do not possess nonderivative final value and thus cannot justify the infringement of individual rights. While recognizing the instrumental and contributory value of species, the paper rejects philosophical arguments that claim species have nonderivative value, such as the replication argument and the last person argument. (...) The author concludes that while there are important conservation duties, they should not violate individual rights, as exemplified by the kangaroo culling practice, which must be abolished. Consensual sexual relationships between faculty and students at universities are a growing issue for administrators. Often times, administrators view these relationships as potential sexual harassment cases given the power disparities that often exist between the parties involved. Therefore, many universities have written policies essentially equating CSRs to sexual harassment. Despite the recent growth of these policies, how faculty compare CSRs and sexual harassment is often overlooked, particularly as it relates to perceived power differentials. The current study examined responses from 166 (...) faculty members to explore these perceptions. Results indicate faculty had varying opinions, depending on previous experience with CSRs and beliefs around power differentials. These findings contribute to previous literature which indicates there is rampant ambiguity and subjectivity when defining and handling CSRs on campus. (shrink)

Divine Simplicity has it that God is absolutely simple. God exhibits no metaphysical complexity; he has neither proper parts nor distinct intrinsic properties. Recently, Jeffrey Brower has put forward an account of divine simplicity that has it that God is the truthmaker for all intrinsic essential predications about him. This allows Brower to preserve the intuitive thought that God is not a property but a concrete being. Discussion of modeling within philosophy of science has focused in how models, understood as finished products, represent the world. This approach has some issues accounting for the value of modeling in situations where there are controversies as to which should be the object of representation. In this work I show that a historical analysis of modeling complements the aforementioned representational program, since it allows us to examine processes of integration of analogies that play a role in the generation of criteria (...) of relevance, which are important for the configuration of the object of research. This, in turn, shows that there are norms in modeling practices whose historical reconstruction is relevant for their philosophical analysis. (shrink)

El estudio utiliza un enfoque analítico-conceptual y una metodología documental, tomando como unidades de análisis a los principales referentes filosóficos sobre la libertad. A través de un análisis comparativo, se identifican los principales cambios y continuidades en la evolución de este concepto, explorando (...) las diversas perspectivas y matices aportados por pensadores clave en la historia occidental. Esta investigación permite comprender cómo la idea de libertad ha sido moldeada por los contextos históricos, sociales y culturales, reflejando las tensiones y los desafíos inherentes a la búsqueda de la autonomía humana. Digital photography is contributing to the renegotiation of the public and private divide and to the transformation of privacy and intimacy, especially with the convergence of digital cameras, mobile phones, and web sites. This convergence contributes to the redefinition of public and private and to the transformation of their boundaries, which have always been subject to historical and geographical change. Taking pictures or filming videos of strangers in public places and showing them in webs like Flickr or YouTube, or making (...) self-portraits available to strangers in instant messenger, social network sites, or photo blogs are becoming a current practice for a growing number of Internet users. Both are examples of the intertwining of online and offline practices, experiences, and meanings that challenge the traditional concepts of the public and the private. Uses of digital images play a role in the way people perform being a stranger and in the way they relate to strangers, online and offline. The mere claims about the privatization of the public space or the public disclosure of intimacy do not account for all these practices, situations, and attitudes, as they are not a simple translation of behaviors and codes from one realm to the other. In philosophy of science, abstraction tends to be subsumed under representation, often being described as the omission of a target’s features when it is represented. This approach to abstraction sidesteps cognitive aspects of abstraction processes. However, cognitive aspects of abstraction are important in understanding the role of historically grounded epistemic criteria supporting modeling in science. Drawing on recent work on the relation between metaphor and abstraction, we introduce the concept of paths of abstraction, and use historical and contemporary examples to (...) point to their role in guiding the development of relevance criteria which support modeling strategies in science.
